Facing the Complexity of the Criminal Negotiation System:Methodological Enlightenment of Plea Bargaining outside the Shadow of Trial

In Plea Bargaining outside the Shadow of Trial,Stephanos Bibas started with the Shadow-of-trial model,used social science knowledge to outline the complexity behind the plea bargaining system from the structural and psychological factors,and took Structural-Psychological perspective as an explanatory theoretical attempter.This would not only provide a reference for the leniency on admission of guilty and acceptance of punishment,but also enlighten the methodological use of social science knowledge for the study of criminal procedural law.In order to obtain theoretical progress to face the complexity,the criminal procedural law research should at least possess three elements:full understanding of practice patterns,rational utility of social science knowledge,and prudent refining of theoretical models.
